Application of case reopen u/s 32 in up vat - VAT

Sub: For requesting to Re-open the case under section 32 against to Order under Sec.28(2)(ii) in the case of M/s XYZ Pvt. Ltd., against TIN: 09316319089 for the Asst. Year 2016-17

Ref: Order issued u/s 28(2)(ii) of UTTAR PRADESH VALUE ADDED TAX Act 2008, Order No.20318905203457

       

                       With reference to the above mentioned subject , We was in receipt of  order under section 28(2)(ii) vide  dated 16-10-2020 order number-20318905200012, wherein you have expressed desire for ex-parte assessment with available information to you against assessment year 2016-2017. 

 

The above mentioned case has been fixed for hearing 30/09/2020 vide your notice. Unfortunately, our accountant was infected with Covid-19 so, we were not in a position to prepare the necessary accounts by the due date and the Accountant, Mr. Jeet Lal was isolated for 21 days ( copy of report attached herewith).Therefore, we are not in a position to attend the hearing. 

I request you to kindly reopen the case under sec.32 as per your convenient date. It is therefore prayed that the ex-party assessment order may be set aside and the case be reopend for fresh assessment.

 

I would request you to please guide me further as to how to proceed in this matter.
