Gift Deed

Be it may be known that first party / Donor is the Joint Owner, Kabiz and Dakhil is going on and her name is being plastered as a co-owner in the ownership of Building No - 50/76,  Sardar Patel Marg, Pargana & Tehsil-Sadar, District-Prayagraj, Allahabad (U.P.) which is built on plot number - 1762A, Civil Station, City Prayagraj (Allahabad), and her name as Joint Owner, Kabiz and Dakhil appears in column of all government records and municipal records.   First party / Donor has neither sold nor transferred her share of the property and its rights to any person or institution nor have executed any registered and unregistered agreement of sale or of any kind other than the sale. Nor has the property been kept as mortgage before any government and non-government financial institution, nor has the property been kept as security before any court. In this way, property is clean and free from encumberances, therefore, first party / Donor has the full statutory right to gift his rights and

shares contained in the above property.

        A servant of mine, i.e first party / donor, namely, Ramu  Yadav S/o Sri Raj Yadav resident of 5, Sardar Patel Marg, Pargana & Tehsil-Sadar, District-Prayagraj, Allahabad (U.P.),  has been serving me, the first party/ donor with love and devotion and is looking after and loves me naturally and keeps on serving, caring, medicine-treating etc. The first party/ donor is very happy with his service, that's why the first party/ donor decided to give him the rewards of his service.

        Hence first party/donor wants to donate a part of the aforesaid property 6,  Sardar Patel Marg, Pargana & Tehsil-Sadar, District-Prayagraj, Allahabad (U.P.),  measuring 22.57 sqm along with the construction existing thereupon and which is constructed over plot no. 2A, Civil Station, City Prayagraj (Allahabad), in favor of second party/donee i.e. his servant Ramu Yadav son of Mr. Raj Yadav. Therefore, the First Party/donor having carefully considering and matter and after consulting his well-wishers with a healthy mind and intellect, without any illegitimate fear and pressure and before witnesses has donated 22.57 sqm land along with the construction over it, which part of the property bearing building number- 6,  Sardar Patel Marg, Pargana & Tehsil-Sadar, District-Prayagraj, Allahabad (U.P.), and situated in plot no. 2A, Civil Station, City Prayagraj (Allahabad), and whole details of which are given at the end of this deed, to his servant Ramu Kumar Yadav son Raj Yadav Second Party/Donee and at the same time Second Party/ Donee has willingly accepted the said donation in front of witnesses. From the date and time of donation, the First Party/Donor withdraws all his rights and possession from the donated property and has handed over the possession of the donated property to the second party/ Donee.

        From today's date, the second party/Donee has become actual owner of the property received in the said donation. Now he has full right and title to use and consume the donated property in whatever way he want and bring it to his use. Second party/ Donee should register the possession, filing and documents of the government in his name, where necessary. The first party/ donor or his inheritors or any body on his behalf will have any objection to it today or at any later stage nor raise any objection in future.

        If any other person presents any claim against this donation of ours, then such a claim would be considered to be ineffective, void and null.

        So the first party / donor has executed this donation deed in favour second party / Donee in front of the witness in writing so that it may be on record and be useful at the time of need.

Building number- 6,  Sardar Patel Marg, Pargana & Tehsil-Sadar, District-Prayagraj, Allahabad (U.P.), Is built on construction of 22.57 sqm land area which is constructed at plot no. 2A, Civil Station, City Prayagraj (Allahabad), The total built-up area is 7.4 sqm (ground floor), which is a kachcha construction and which is built more than 100 years old, has been donated with rights and privileges. The boundary of which is the following: -

Measurement :-

East – 27 fit

West – 27 fit

North – 9 fit

South – 9 fit

BOUNDARY :-

East – Abha Devi's house

West – Titto Yadav’s house

North – Other's property

South – 10 fit wide cast way

NATURE (KAIFIAT)

Be aware that the said property is being given in  gift and the property donated is located on a 10 feet wide road, that is residential. Circle rate fixed by District Magistrate is 40. At the rate of Rs. 40,500/- per square meter, the land area is 22.57 sqm. The property is Rs. 9,14,275/- and the total built up area is 7.4 sqm which is raw tile and built more than 100 years old. , The property is worth Rs. 48,100/- in the rate of Rs. 6,500/- per square meter.

Thus, the total property value of the property is Rs. 9,62,375/- or say Rs. 9,63,000/-, payable stamp duty per the of Uttar Pradesh Government Order no. Sa.Vi.Ka.Ni.-5-27656/11 dated - June 30, 2008, is Rs. Mubalik ................./ - Indian non-judicial stamp duty of rupees is being paid.

Thus, the total property value of the property is Rs. 9,62,375/-, but as per the convenience of Uttar Pradesh Government Order no. Sa.Vi.Ka.Ni.-5-2866/11 dated - June 30, 2008, stamp duty of Rs. 67,600/- is payable, out of which Rs. -------------------- / - through rupees e -stamp certificate number - IN -UP --------------- - By the date --------- and the remaining non-judicial stamp duty of Rupees Mubalik ---------------- / - is being paid.

This is with reference to the above mentioned subject; we wish to submit as under for your kind consideration:

 

1.    With reference to Point 1(one) of the said letter, wherein a query has been raised that brief description of development work plan has not been uploaded, in this regard we wish to submit that the same has now been uploaded on the portal.

 

2.    With reference to Point 2(two) of the said letter, wherein a query has been raised that permit no. is incompletely mentioned, in this regard we wish to submit that complete permit no. has now been mentioned on the portal.

It is declared hereby that both the names belong to the same person only and it was an unintentional human error on part of Prayagraj Development Authority.

 

4.    With reference to Point 4 & 6 of the said letter, wherein consortium agreement and land registry were asked, we wish to submit that “Registry and Khatoni details of Land owners” have been uploaded on the portal. Further we wish to emphasize that registered Joint Development Agreement in favor of Promoter has already been uploaded on the portal.

 

5.    With reference to point 5 (five) of the said letter, wherein a query has been raised that CA, Engineer and Architect Certificates of the project are not uploaded, in this regard we wish to submit that the same has now been duly uploaded on the web portal.

Application U/S 31 of UP VAT Act

Sir,

               The applicant begs to state as under:-

1. That by an order dated 27.02.2021 he has been assessed to a tax of Rs. 13,97,580.02 on a net turnover of Rs. 1,02,65,363.72 for the year 2016-2017.

2. That applicant was given credit of ITC of Rs. 2,06,8455.00 and deposit of Rs. 11,63,389.00 and thereby a demand of Rs. 27,864.02 was created.

3. That however applicant had claimed ITC of Rs. 2,255808.00 (41,037.00 + 1,88,771.00) as per Form 52 filed by him.

4.  That since applicant has deposited Rs. 11,63,389.00 through challans therefore tax on purchases from unregistered dealers stands deposited and applicant is entitled to ITC of Rs. 41,037.00 on the same. Applicant is further entitled to ITC of Rs. 1,88,771.00 on purchases from registered dealers against tax invoice. The total ITC earned comes to Rs. 2,29,808.00.

5. That after grant of above ITC total deposit + ITC will come to Rs.  16554,389.00 + 2,29,808.00 = Rs. 13,93,197.00 and the demand will be reduced to Rs. 4,383.02.

6. That the mistake pointed above is apparent on the face of record which can be rectified U/S 31 of the U.P. VAT Act.

              

 It is therefore prayed that the mistake pointed above be rectified resulting in reduction of tax payable by Rs. 22,781.00 to Rs. 4,353.02.
